Terms of Service

1. Acceptance of Terms

By accessing and using CHATune ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

We reserve the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service shall be subject to the Terms of Service.

2. Description of Service

CHATune provides a platform for creating, customizing, and deploying AI agents. The Service includes:

• AI-powered agent creation and customization
• Collaborative workspace for editing agent instructions
• Version control for agent instructions
• API endpoints for agent deployment
• Integration capabilities with third-party services

3. User Accounts

You are responsible for maintaining the security of your account and password. CHATune cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

You are responsible for all content posted and activity that occurs under your account (even when content is posted by others who have accounts under your account).

You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.

4. User Content and Conduct

You retain all rights to the content you create on CHATune, including agent instructions, user inputs, and any other materials you submit.

By making your agent instructions public, you grant CHATune a non-exclusive, worldwide, royalty-free license to display and distribute those instructions to other users of the Service.

You agree not to use the Service to:

• Upload or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
• Use the Service to create agents that violate applicable laws or regulations

5. API Usage and Integration

When you deploy an agent through CHATune, you receive API access to that agent. You agree to:

• Use the API in accordance with the provided documentation
• Not abuse or overload the API with excessive requests
• Keep your API credentials secure and confidential
• Not share your API credentials with unauthorized parties

6. Privacy and Data Protection

We take your privacy seriously. Your agent instructions and conversations are private by default unless you choose to make them public.

We use industry-standard security measures to protect your data, including encryption for data in transit and at rest.

We may collect and analyze usage data to improve the Service, but we will never share your personal information or private content with third parties without your explicit consent.

7. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by CHATune and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of CHATune.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service or delete your account from your Profile page.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. CHATune makes no warranties, expressed or implied, regarding the Service's reliability, availability, suitability, or accuracy.

AI-generated content may not always be accurate, appropriate, or free from errors. You are responsible for reviewing and validating any AI-generated content before using it.

10. Limitation of Liability

In no event shall CHATune, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service will be resolved in accordance with the laws of the jurisdiction where CHATune operates.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
